The question is no longer &#8220;Do we need to comply?&#8221; but rather &#8220;What is our website still missing to meet the legal requirements?&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">This article answers that question in the most practical way possible. Instead of simply explaining legal provisions, it provides clear guidance that helps your marketing, IT, and legal teams work toward the same goal.<\/span><\/p>\n<h2><span style=\"font-family: arial, helvetica, sans-serif;font-size: 12pt;color: #ff6600\"><b>Where is your website collecting personal data?<\/b><\/span><\/h2>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Before discussing compliance, you first need to understand what data your website is collecting.<\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">A typical business website interacts with customer data through at least six to eight touchpoints, many of which collect information automatically without requiring users to fill out a form.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><b>Active touchpoints (data provided directly by users)<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Contact forms, free trial registrations, and order forms<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Newsletter and free resource subscription forms<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Chatbots and live chat that request a visitor&#8217;s name and email at the beginning of a conversation<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Account registration forms<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><b>Passive touchpoints (technical data collection)<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Cookies that track browsing behavior (Google Analytics, Facebook Pixel, Hotjar, etc.)<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">&#8220;Find a store near you&#8221; features that access location data<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Device storage such as localStorage and session IDs<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Third-party advertising pixels embedded on your website<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><b>Why does this matter?<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">The law does not distinguish between data collected through forms and data collected through cookies. As soon as your organization performs any personal data processing activity &#8211; including collecting, storing, analyzing, or sharing personal data with third parties &#8211; the legal requirements for obtaining consent apply.<\/span><\/p>\n<h2><span style=\"font-size: 12pt;font-family: arial, helvetica, sans-serif;color: #ff6600\"><b>General personal data vs. sensitive personal data: What is your website collecting?<\/b><\/span><\/h2>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Under Article 2 of Law No. 91\/2025\/QH15, personal data is divided into two categories, each with a different level of legal protection.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><b>General personal data<\/b><span style=\"font-weight: 400\"> includes basic information such as a person&#8217;s full name, gender, date of birth, email address, and phone number. Most contact forms and account registration forms fall into this category.<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><b>Sensitive personal data<\/b><span style=\"font-weight: 400\"> includes health information, financial data (such as bank account details and transaction history), precise location data, biometric information (such as fingerprints and facial recognition), and political or religious views.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Businesses should pay particular attention because many seemingly harmless website features actually collect sensitive personal data.<\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">For example: An online loan application form collects financial information, a home delivery feature collects location data, an online health check registration form collects medical information.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><span style=\"font-weight: 400\">When sensitive personal data is involved, the law requires <\/span><b>separate and explicit consent<\/b><span style=\"font-weight: 400\">. A valid consent must satisfy all four of the following principles.<\/span><\/p>\n<h3><span style=\"font-family: arial, helvetica, sans-serif\"><b>1. Freely given<\/b><\/span><\/h3>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Customers must have a genuine choice to either agree or refuse. They must not be forced into providing consent or be required to consent as a condition for using a service, except where certain personal data is strictly necessary to deliver that service.<\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">For example, a cookie banner that only displays an &#8220;Accept&#8221; button without a clearly visible &#8220;Reject&#8221; option does not meet this requirement.<\/span><\/p>\n<h3><span style=\"font-family: arial, helvetica, sans-serif\"><b>2. Specific to each purpose<\/b><\/span><\/h3>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">One consent cannot cover every purpose. If you intend to use a customer&#8217;s email address to: send order confirmations, send promotional newsletters, and share the information with distribution partners, you must obtain separate consent for each purpose. Customers should be able to agree to one purpose while declining another.<\/span><\/p>\n<h3><span style=\"font-family: arial, helvetica, sans-serif\"><b>3. Demonstrable<\/b><\/span><\/h3>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><span style=\"font-weight: 400\">You must be able to prove: <\/span><b>who <\/b><span style=\"font-weight: 400\">gave consent, <\/span><b>when <\/b><span style=\"font-weight: 400\">the consent was given,<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><span style=\"font-weight: 400\">exactly <\/span><b>what <\/b><span style=\"font-weight: 400\">they agreed to, including the version of the form or privacy policy shown at that time, and through which channel the consent was collected. If regulators conduct an inspection, you must be able to provide this evidence instead of simply stating that the records exist.<\/span><\/span><\/p>\n<h3><span style=\"font-family: arial, helvetica, sans-serif\"><b>4. Easy to withdraw<\/b><\/span><\/h3>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Withdrawing consent should be just as easy as giving it. What you really need is a complete consent management system.<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;font-family: arial, helvetica, sans-serif\">Here are some of the most common gaps found on business websites in Vietnam today.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-family: arial, helvetica, sans-serif\"><b>No audit log<\/b><span style=\"font-weight: 400\">: When a customer gives consent through a form, what happens next? Where is the consent stored? Who is responsible for managing it? How long is it retained? If regulators request proof during an inspection, can you provide it?<\/span><\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-family: arial, helvetica, sans-serif\"><b>No effective withdrawal process: <\/b><span style=\"font-weight: 400\">A customer unsubscribes from marketing emails using the unsubscribe link, but the CRM still labels them as &#8220;marketing eligible&#8221; and continues to target them with advertisements. This is still a violation, even though the customer has already withdrawn their consent.<\/span><\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-family: arial, helvetica, sans-serif\"><b>Consent data is scattered across multiple systems: <\/b><span style=\"font-weight: 400\">Consent may be collected on the website but never synchronized with your email marketing platform, customer data platform (CDP), or CRM. As a result, no one knows exactly who has consented to what, or when.<\/span><\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-family: arial, helvetica, sans-serif\"><b>Poor cross-functional coordination: <\/b><span style=\"font-weight: 400\">Marketing wants to use customer data. IT manages the systems. The legal team is responsible for compliance risks. Under Decree No. 356\/2025\/ND-CP, businesses have two working days to respond to a request to withdraw consent and 15\u201320 days to complete the required actions.
