FPT.eContract eBook – A “handbook” for adoption of electronic labor contracts

All concerns related to legal validity, forms of signing, confidentiality and applicability of electronic labor contracts have been addressed by FPT Information System Corporation (FPT IS) in an eBook called “Everything you need to know about electronic labor contracts”.

Although it has been facilitated and promoted in recent years, electronic labor contracts still face multiple challenges in practice. According to a survey from hundreds of attendees at the webinar themed “Electronic labor contract: From legal view to practice” organized by FPT IS, legal validity, security, forms of signing and applicability are companies’ main concerns regarding electronic labor contracts.

In which, almost half of the questions relate to legal validity of the electronic labor contracts, such as: Is the legal validity of electronic labor contracts guaranteed in all cases, or What is the right way to adopt electronic labor contracts in accordance with the laws and ensuring legal validity?

Legal validity of electronic labor contracts has been consolidated as the Labor Code 2019 has officially taken effect from January 1, 2021 with multiple radical changes regarding labor contracts to better ensure the legitimate rights and interests of employees and employers, including recognition of legal validity of electronic labor contracts.

At the “Electronic labor contract: From legal view to practice” webinar, Mr. Mai Duc Thien, Deputy Director of the Legal Department, Ministry of Labor – Invalids and Social Affairs, says: “Article 14 of the Labor Code 2019 stipulates that “An labor contract in the form of electronic data conformable with electronic transaction laws shall have the same value as that of a physical contract”.

Ms. Duong Tieng Thu – Senior Associate, Phuoc & Partners Vietnam Company Law – also affirms that the electronic labor contract has helped companies get rid of multiple big issues, and particularly, promotes the adoption of personal digital signature. “According to Article 9 of Decree 130/2018/ND-CP, organizations that can provide digital signature services include: Vietnam National Root Certification Authority; Specialized certification authorities of the Government; Public digital signature certification service providers; Specialized certification authorities of agencies and organizations issued with certificates of eligibility for special-use digital signature security”, said Ms. Thu.

Besides legal validity, other concerns such as forms of signing, security and applicability, also hinder companies from switching to electronic labor contracts.
